Case before the Supreme Court of Lithuania regarding the obligation to pay a special fee

Our team has successfully represented the operator of Lithuania’s Natural Gas Transmission System before the Supreme Court of Lithuania in a case regarding the obligation to pay a special fee for the Liquefied Natural Gas (LNG) Terminal.

The court of first instance satisfied the client’s claim in part; it obliged the defendant to pay a special fee but reduced the fine on the grounds that it was manifestly excessive. Both the claimant and the defendant challenged this decision. The Court of Appeal dismissed the defendant’s claim and decided to satisfy our Client’s claim in full scope including the claim to administer a fine.

The defendant submitted a cassation complaint, asking the Supreme Court of Lithuania to reverse the decision of the Court of Appeal and refer the case back to the court of first instance. However, the Supreme Court upheld all of the arguments set forth by the Motieka & Audzevičius team and confirmed the judgment of the Court of Appeal.

This decision is of great importance as it ensures the financing of the strategic LNG Terminal of Lithuania and prevents further disputes with the other payers of the LNG Terminal fee.
