Case before the Moscow City Court

Motieka & Audzevičius together with Monastyrsky, Zyuba, Stepanov & Partners has successfully represented the client in recognition and enforcement proceedings of Lithuanian Court of Appeal decision before the Moscow City Court.

The decision ordered defendants to jointly and severally pay the client more than 15 million EUR. Importantly, the principal debtor has consistently sought to sabotage the proceedings by deliberately not accepting the serviced court document, changing representatives and concealing his property.

The Moscow City Court agreed with all of our arguments “for” recognition and enforcement of the decision and granted our request. This is a landmark case in preventing the dilatory tactics by award and decision debtors, who seek to escape liability by exploiting procedural loopholes.
