Arbitral award recognized in the Court of Appeal of Lithuania

The Court of Appeal of Lithuania has recognized and enforced an Arbitral award rendered by an Arbitral Tribunal constituted under the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce. The dispute concerned a debt owed by a Belarusian company (defendant) to a Lithuanian company (the claimant represented by Motieka & Audzevičius) under a loan agreement.

In its ruling the Court of Appeal provided a significant analysis of the legal matters related to, among other issues, the assignment of arbitration agreement and the relationship between the Lithuania-Belarus Treaty on Legal Assistance, The Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents and the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards in the light of the service of documents in enforcement proceedings.
